New Delhi | Parliament Winter Session | Leader of the Opposition in Lok Sabha Rahul Gandhi strongly criticised the BJP-led government and raised serious concerns about the functioning of the Election Commission while speaking in the Lok Sabha during the Winter Session on election reforms.
Rahul Gandhi said that the BJP was “directing and using the Election Commission to damage India’s democracy,” and he placed three important questions before the House.
First, he asked why the Chief Justice of India (CJI) was removed from the selection panel for appointing the Election Commissioner. He said the selection meeting is not truly democratic because it includes only the Prime Minister, the Home Minister and the Leader of the Opposition. “In that room, I have no voice. What they decide is what happens,” he said, questioning why the government is so keen on choosing the Election Commissioner.
Second, he pointed out that in December 2023, the government changed the law to give complete immunity to Election Commissioners for any action taken while they are in office. He said that no Prime Minister in India’s history has ever given such a benefit. He questioned why such a special “gift of immunity” was needed.
Third, he questioned the change in rules allowing the Election Commission to destroy CCTV footage from polling booths just 45 days after voting. “This is not about data. This is about stealing the election,” he said.

Rahul Gandhi then explained that electoral reform is simple, but the government does not want to do it. He demanded that political parties should receive machine-readable voter lists at least one month before elections. He said the law allowing destruction of CCTV footage should be withdrawn and complete clarity must be given on the architecture of EVMs. He also demanded that experts from political parties be allowed to inspect EVMs, saying that access has still not been given.
He added that the law giving immunity to the Election Commissioner must be changed. He also warned the Election Commissioners who feel protected under the new law: “We will change the law retroactively, and we will come and find you.”
Rahul Gandhi further said that the “biggest anti-national act” is Vote Chori. He said that stealing votes destroys the fabric of the country and weakens the idea of India. “Those across the aisle are doing an anti-national act,” he said in the Lok Sabha.

Rahul Gandhi’s remarks created a sharp discussion in the House, with the Opposition demanding transparency and the government strongly rejecting the charges. As the Winter Session continues, the issues raised by the Leader of the Opposition are expected to bring more debate on the need for fair elections, stronger accountability and protecting the democratic values of the country.
