All India Muslim Personal Law Board Disappointed with Supreme Court’s Interim Order on Waqf Act 2025

New Delhi | The All India Muslim Personal Law Board (AIMPLB) has expressed disappointment over the Supreme Court’s interim judgment on the Waqf (Amendment) Act 2025, calling it incomplete and unsatisfactory.

In a statement, Board spokesperson Dr. S. Q. R. Ilyas said that while the apex court has stayed certain provisions of the amendment, the community had expected relief from all clauses that go against the Constitution. “While the Court has granted partial relief, it has not addressed the wider constitutional concerns, which has left us disappointed,” he said.

Dr. Ilyas pointed out that many provisions are arbitrary and could be misused against the Muslim community if not stayed. “The way government functionaries act in a prejudiced manner, we fear that the provisions not stayed will be abused,” he added.

Key Reliefs Granted by the Supreme Court

The Supreme Court’s interim order has provided relief in some important areas:

* Protection of Property Rights: Waqf properties cannot be dispossessed or altered in records until a final decision is delivered. The Court stayed the rule requiring a government officer’s report to validate waqf ownership.

* Prevention of Arbitrary Powers: Section 3C of the Act has been stayed, preventing government officers from unilaterally deciding who can create a waqf.

* Separation of Powers: Revenue officers cannot decide property ownership matters, keeping in line with the principle of separation of powers.

* Non-Muslim Membership: The Court directed that the Central Waqf Council cannot have more than 4 non-Muslim members (out of 22), and State Waqf Boards cannot have more than 3 non-Muslim members (out of 11).

* Five-Year Requirement Stayed: The requirement that a person must prove they were practicing Islam for five years to create a waqf has been stayed until proper rules are framed.

All India Muslim Personal Law Board’s Stand

Despite these partial stays, the AIMPLB said the amendment is a deliberate attempt to weaken and seize waqf properties. The Board has demanded the ‘complete repeal of the Waqf (Amendment) Act 2025’ and restoration of the earlier Waqf Act.

The Board highlighted that harmful provisions remain, such as the cancellation of “waqf by user” and the mandatory requirement of a written waqf deed, both of which go against Islamic principles.

Save Waqf Campaign to Intensify

Dr. Ilyas announced that the Save Waqf Campaign will continue with full strength. The second phase, launched on 1 September 2025, includes dharnas, demonstrations, waqf marches, memorandums, leadership arrests, roundtable meetings, interfaith conclaves, and press conferences.

Nationwide protests will culminate in a massive rally at Ramlila Maidan, Delhi, on 16 November 2025, with participation from across the country.

The All India Muslim Personal Law Board has made it clear that the struggle for protecting waqf properties will continue until justice is done. While the Supreme Court’s interim order has given partial relief, the Board and the community believe that only the complete repeal of the Waqf (Amendment) Act 2025 can safeguard their rights. With nationwide protests planned and a massive rally in Delhi on November 16, the issue is set to remain at the centre of public and legal debate in the coming months.
